General Terms and Conditions of Use and Sale

Salento Open Source, grants the access to the site www.opencitiesonline.com and it sells its products to the buyers (hereinafter "Customer"), under the following general conditions of use and sale which Salento Open Source invites to carefully read before using the website.

I) CONDITIONS RELATING TO THE SALE OF PRODUCTS

1. THE CONTRACT

The display of goods and services on the virtual shop-window of the website constitutes an invitation to treat. The purchase proposal (Order) is formulated by the Customer when it sends the module including the products required with price and modalities of payment and shipping (Order Form). If the customer wants to buy the products on the site, he can select and add them to the shopping basket; once all the products have been selected, the customer can close the shopping basket by using the “Proceed to Checkout” button.
To this point, a page containing the summary of the selected products with their prices and the delivering methods and costs, will appear. The customer can choose his preferred delivery, transport and payment method among those available. For sending an order (considered as a contractual proposal made to Salento Open Source), the customer must use the appropriate “Confirm” button. After receiving the order, Salento Open Source will send to the customer an e-mail of acceptance and order confirmation.

2. PRICES AND TERMS OF PAYMENT

The prices indicated on the website are inclusive of VAT. The accepted methods of online payment are: Credit Card, PayPal account and bank transfer. The online transactions are made through a secure connection, adopting the SSL security system (Secure Socket Layer). At no time during the purchasing process Salento Open Source is able to acquire knowledge of the customer's credit card number, because this information is transmitted directly to the Bank's protected site which manages the transaction. For this reason, Salento Open Source cannot be held liable for any fraudulent use of credit cards made by third parties.

3. RETURNS

In according with the article 64 and the following articles of Legislative Decree no 206/2005, (Consumer Code), within 10 working days from receipt of the product, the customer may exercise the right of withdrawal by sending a registered letter with return receipt addressed to Salento Open Source, Via A. Volta, 21 - 73055 Racale (LE), containing: signed declaration of the will to exercise the recess right. Copy of the order confirmation sent by Salento Open Source by e-mail, indicating the details of the order. The right of withdrawal shall be subjected to the following conditions: The Customer must be a consumer (physical person who buys the goods for purposes not related to his professional activities, who makes their purchase without indicating, in the order form, a VAT number). The right of withdrawal is also subjected to the following conditions: It is not possible to apply the right to a single part of the product (ex. accessories, attachments etc.) The right does not apply to sealed audio-visual products, if already opened.
The product must be returned intact and in original packaging within 20 working days. The cost for returning the product will have to be paid by the customer; the expedition is under the full responsibility of the customer until the confirmation of receipt from Salento Open Source. Salento Open Source shall not be liable for any damage, theft or loss of goods returned with uninsured delivery. The amount will be credited back to the customer's credit card or PayPal account.

4. WARRANTIES AND RESPONSIBILITIES

The products sold on the website will be subjected to the rules in the legal guarantee of conformity and commercial guarantees for consumer goods following the applicable national and community rules, among which there’s the consumer code. Salento Open Source shall not be liable for any loss any damage suffered by the Customer, that are not an immediate and direct consequence of our failure or which was not reasonably foreseeable on the occasion of the use of the website or when the contract is concluded.

5. CLAIMS

Any claim should/shall be directed to Salento Open Source, no-profit association, Via A. Volta, 21 - 73055 Racale (LE).

6. LAW APPLICABLE

The sales contract between Salento Open Source and the customer is concluded in Italy and regulated by Italian laws. Competent court for any possible civil or penal disputes: If the Customer is a consumer (physical person who buys the goods for purposes not related to his professional activities, who makes their purchase without indicating, in the order form, a VAT number) the competent court is that of his town of residence. In all other cases, the competent court is that of Lecce.

II) CONDITIONS RELATING TO THE USE OF THE WEBSITE

7. THE ACCOUNT

For shopping in our website, the customer needs to be registered, by submitting his personal data, telephone number, e-mail address and a password (login credentials). Salento Open Source invite you to check the accuracy of the personal data provided and timely response for any changes, remembering that the customer will be criminally responsible for any false declaration made to Salento Open Source. The customer is invited to keep confidential his access credentials to the website and to control access to the computer, so as to prevent any access that is not authorised, because he is responsible for all the activities carried out by using his access credentials; simultaneously, the customer undertakes to promptly inform Salento Open Source if it is suspected that third parties have become aware of the access credentials and had an unauthorised use.

8. ACCESS TO THE WEBSITE

Salento Open Source shall take all the measures necessary to ensure the access to the web site without interruption and the transmission of data without errors. However, during the website maintenance and improvement works, it is possible that the access to the website may also be occasionally suspended or restricted; Salento Open Source will seek to minimise these interruptions, by limiting the disservice to the less critical hours.

9. USE OF THE WEBSITE BY MINORS/PERSONS UNDER THE AGE OF 18

If the visitor is under 18 years old, he can use the website under the supervision of a parent or a guardian, because Salento Open Source doesn’t sell products to minors.

10. ELECTRONIC COMMUNICATIONS

For the purpose of this contract, the Customer agrees that all contracts, communications, notifications and information that Salento Open Source provides electronically (by sending email or communications on the website) satisfy the written form requirement, without prejudice to the rights provided by the Law.
